Bioweapons Accountability Act

Section 1: Title

This Act shall be known as the "Bioweapons Accountability and Prohibition Act."

Section 2: Findings and Purpose

  1. Findings:

    • The development, production, and use of biological weapons are prohibited under the Biological Weapons Convention (BWC), to which the United States is a party.

    • The development of bioweapons poses an existential threat to humanity, violates international law, and undermines global security.

    • There is an urgent need to hold individuals and organizations accountable for involvement in bioweapons development.

  2. Purpose:

    • To establish the development or deployment of biological weapons as a capital crime in cases of mass harm or intent to cause mass casualties.

    • To strengthen oversight, enforcement, and international cooperation to prevent bioweapons development.

    • To establish severe penalties for individuals and entities involved in the research, development, production, or dissemination of biological weapons.

Section 3: Definitions

For the purposes of this Act:

  1. Biological Weapon: Any microbial or other biological agent, toxin, or delivery system intended for use as a weapon to cause harm to humans, animals, plants, or the environment.

  2. Involvement: Includes research, funding, production, distribution, or facilitation of bioweapons development.

  3. US Citizen: Any individual holding citizenship in the United States or entities registered under US law.

Section 4: Prohibited Activities

  1. It shall be unlawful for any individual or entity to:

    • Develop, produce, acquire, transfer, or stockpile biological weapons.

    • Provide funding, resources, or technical assistance for the development of biological weapons.

    • Engage in international collaboration with the intent to create bioweapons.

  2. Violation of these provisions shall be treated as a capital offense of the highest degree.

Section 5: Penalties

  • Capital Punishment for Direct Involvement:

    • Any individual found guilty of developing, deploying, or directly facilitating biological weapons with the intent to cause mass harm shall face the death penalty.

    • Conviction must meet the highest standards of evidence and due process under federal law.

  • Severe Consequences for Complicity:

    • Individuals and entities indirectly involved shall face:

      • Life imprisonment without parole for individuals.

      • Asset seizure and permanent operational bans for entities.

  • Whistleblower Protections:

    • Individuals disclosing credible evidence of bioweapons activity in good faith shall be granted immunity from prosecution and federal protection under whistleblower laws.

Section 6: Oversight and Enforcement

  1. Creation of a Bioweapons Enforcement Division:

    • Establish a specialized division within the Department of Justice to investigate and prosecute bioweapons violations.

    • Collaborate with international organizations to enforce global compliance with the Biological Weapons Convention.

  2. Mandatory Reporting:

    • All research institutions, corporations, and government agencies shall submit annual certifications of compliance with bioweapons prohibitions.

  3. Enhanced Whistleblower Channels:

    • A secure, anonymous reporting system for individuals to report suspected violations.

Section 7: International Cooperation

The United States shall:

  1. Provide technical assistance to countries to strengthen compliance with the Biological Weapons Convention.

Section 8: Implementation

This Act shall take effect 180 days after its passage. The President, in consultation with the Attorney General and Secretary of Defense, shall issue regulations to implement this Act.

Section 9: Severability

If any provision of this Act is found unconstitutional or unenforceable, the remaining provisions shall remain in full force and effect.
